All such Confidential Information disclosed to you as a customer of the Company shall be held in strict confidence. You also agree not to post, disclose, or comment about the links that you receive or strategies that the Company discloses. You and your firm will be held PERSONALLY liable for any above discretions. In addition to the foregoing, you hereby declare that you are NOT employed by Google, have no affiliation with Google (such as "Leapforce at Home"), and have NO relatives that are employed by Google.

You hereby agree that your failure to perform any obligation or duty under this Agreement will cause irreparable harm to the Company, which harm cannot be adequately compensated for by monitary damages. It is further agreed by you that an order of specific performance or for injunctive relief against you in the event of a breach or default, or an attempted breach or default, under the terms of this Agreement would be equitable and would not work a hardship on you. Accordingly, in the event of a breach or default, or an attempted breach or default, by you hereunder, the Company, without any bond or other security being required and in addition to whatever other remedies are or might be available at law or in equity, shall have the right either to compel specific performance by, or to obtain injunctive relief against, you, with respect to any obligation or duty herein or breach thereof.

Proprietary Information

The material and Content (hereinafter referred to as the "Content") accessible from HKSEO, and any other World Wide Web site owned, operated, licensed, or controlled by our Company is the proprietary information of our Company or the party that provided the Content to our Company, and our Company or the party that provided the Content to our Company retains all right, title, and interest in the Content. BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS COMPANY FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY COMPANY DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER COMPANY OR LAW ENFORCEMENT AUTHORITIES.

Miscellaneous

These Terms of Use will be governed and interpreted pursuant to the laws of Texas, United States of America, notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in Texas in connection with any dispute between you and Company arising out of these Terms of Use or pertaining to the subject matter hereof. The parties to these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use or pertaining to the subject matter of these Terms of Use will be in the state and federal courts in Houston, Texas. If any of these Terms of Use is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms of Use constitute the entire agreement among the parties relating to the subject matter.
